Case Study #1

Client X has an Iraqi father and French mother and currently lives in the France. Client X’s father has two properties in Baghdad (a house in the Mansur district and a small farm in an unknown district) registered in his name. Client X’s father died two years ago and Client X now wants to sell her share in the property. Iraq Lawyer would manage this case as follows:

1. Client X grants Iraq Lawyer attorneys in Baghdad Power Of Attorney through the Iraqi Embassy in Paris.
2. The Iraq Lawyer attorneys file an application with the relevant Court of Personal Affairs in Baghdad to establish the rightful heirs to Client X’s father. The Court, after carrying out due diligence investigations, issues the Qassam Sher’i legal document establishing the heirs and their respective shares in the inheritance.
3. For the house in Mansur the matter is straightforward. Iraq Lawyer attorneys can arrange for the house to be sold at the best market price and for Client X to receive her rightful share of the rocordings.
4. With regards the farm whose location is unknown, Iraq Lawyer attorneys will attend the General Directorate of Property Registration in Baghdad and conduct a search of all properties registered in the name of the deceased. Once the farm property registered in the name of the deceased is located, Iraq Lawyer attorneys can arrange for the farm to be sold at the best market price and for Client X to receive her share of the proceedings.
